Same Sex Divorce

As same sex couples have been able to get married since 2014 family law solicitors are receiving increasing numbers of enquiries about same sex divorce. Family solicitors will tell you that there is no real difference in the operation of the law and the process of same sex divorce and any other divorce. That also applies to the law on how to end your civil partnership or how you resolve who the children will live with and the contact arrangements, who will get to stay in the family home and the details of your financial settlement.

Whether you are married or unmarried and whatever the nature and status of your relationship, the important question is can you work with your family lawyer? You don’t necessarily need to like them (though it does help) but you do need to be able to trust them and believe that they are doing the best they can for you.

It may seem odd that a divorce solicitor is saying that as the law is the same, whether you are in a same sex marriage or not, it therefore follows that your divorce should be no more complicated than anyone else’s marriage breakdown. However, the key point is that it is your same sex divorce so it is complicated and traumatic to you and you therefore need and deserve a solicitor with a bit of empathy to the situation you find yourself in, who will listen to what you want, and will then do their job to make your same sex divorce as stress free as possible for you and your family.
